Terms of Use

Welcome to Kids‐Tokei’s website. These Terms of Use (“Terms”) govern your access to and use of our website, applications, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Eligibility

By using our Service, you represent and warrant that you are at least 18 years old or, if under 18, that you have obtained the consent of a parent or legal guardian. You also warrant that you have the legal capacity to enter into these Terms and that you will not use the Service for any unlawful purpose.

2. User Accounts

In order to make a reservation or access certain features, you may be required to create an account. When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials (e.g., username, password), and you agree to accept responsibility for all activities that occur under your account.

3. Privacy and Personal Data

We collect, use, and share personal information in accordance with our Privacy Policy. By using the Service, you consent to our collection, use, and disclosure of personal information as described therein.

4. Reservations and Payments

  1. Reservations: All reservations are subject to availability. Once you submit a reservation request, you will receive a confirmation email if your reservation is successful.
  2. Fees: Fees for our Services (e.g., photo session packages) are clearly displayed on the relevant pages. You agree to pay all applicable fees, including any taxes or charges, in the currency specified.
  3. Refund & Cancellation: You may cancel your reservation up to 48 hours before the scheduled session without penalty. For cancellations made within 48 hours of the session, a 50% cancellation fee applies. No-shows or cancellations less than 2 hours before the session are non-refundable. Any refunds will be processed via the original payment method within 7–10 business days.
  4. Changes: If you wish to change your reservation date/time, please visit your “My Reservation” page. Changes are subject to availability and must be made at least 24 hours before the original session time. A fee may apply for late changes.

All content, features, and functionality of the Service (including text, graphics, logos, images, video, and software) are owned by Kids‐Tokei or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any portion of the Service without our prior written consent.

The Service may contain links to third-party websites or services that are not owned or controlled by Kids‐Tokei. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. Visiting such links is at your own risk.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Kids‐Tokei makes no representations or warranties of any kind, express or implied, regarding the Service, including but not limited to, merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

9. Limitation of Liability

To the fullest extent permitted by law, Kids‐Tokei, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. In no event shall our total liability exceed the amount you paid, if any, to use the Service in the past six months.

You agree to defend, indemnify, and hold harmless Kids‐Tokei and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of another.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of laws principles. Any dispute arising under or relating to these Terms shall be first attempted to be resolved through good-faith negotiation. If the parties cannot resolve the dispute, it shall be submitted to mediation in Sydney, NSW. If mediation fails, either party may pursue any rights or remedies available under the law in the courts of New South Wales.

12. Changes to These Terms

We may modify these Terms at any time by posting the updated version on this page. The “Last Updated” date below indicates when these Terms were most recently revised. Your continued use of the Service after such changes will constitute your acceptance of the updated Terms.
